New Toronto Land Transfer Tax

On October 22, despite much opposition and lobbying from Toronto Real Estate Board and its many members, Toronto City Council approved a new land transfer tax. That tax will take effect on February 1, 2008.

The new tax will be in addition to the provincial land transfer tax, and will be calculated as follows:

First time buyers purchasing new and resale residences will receive a rebate of $3,725. That means a purchase up to and including $400,000 by the first time buyer will be tax-free. But the tax will have to be paid on closing, and the first time buyers will have to fill in a form and apply for a refund.

All agreements signed before December 31, 2007 will be eligible for a full refund of the new land transfer tax, even if the closing happens after February 1, 2008.

All agreements signed after December 31, 2007, but closing before February 1, 2008 will also be eligible for a full refund.

All agreements signed after December 31, 2007, and closing after February 1, 2008 will be subject to the new tax.
